Administrative Law Judge confirms discovery ongoing in Case No. 2026-CFP-00004 while granting Checkout.com extension to file response

COVINGTON, LA, UNITED STATES, August 16, 2026 /EINPresswire.com/ -- A federal whistleblower retaliation proceeding against global payments company Checkout.com is advancing before the U.S. Department of Labor's Office of Administrative Law Judges (OALJ), with discovery confirmed as ongoing and Checkout.com's Complaint Response now due on or before August 27, 2026.

The case, Peters v. Checkout.com, Case No. 2026-CFP-00004, was filed by James Peters on January 28, 2026, when he submitted a whistleblower complaint with the Occupational Safety and Health Administration (OSHA) alleging violations of the employee-protection provisions of the Consumer Financial Protection Act (CFPA), 12 U.S.C. § 5567. OSHA dismissed the complaint on February 25, 2026. Peters appealed the dismissal, and the OALJ docketed the case on March 24, 2026. The matter was assigned to Administrative Law Judge Heather C. Peters will be given an opportunity to oppose Checkout.com's anticipated standing challenge once filed. The August 10 order does not resolve the standing challenge or the merits of Peters's CFPA claim.

Peters is representing himself in the proceeding without legal counsel. The case is being heard in Indianapolis, Indiana, and the CFPA provides that if the Department of Labor does not issue a final decision within 210 days of the original complaint, Peters retains the right to bring the matter before a federal district court.
